Understanding Energy Regulations in Zimbabwe

Navigating the legal and regulatory framework for the generation, transmission and distribution of energy in Zimbabwe can be complex for entrepreneurs looking to enter the energy sector in Zimbabwe. It's essential to understand and comply with the existing regulatory framework:

Key Legal Framework

The principal law governing the construction and operation of power generation facilities in Zimbabwe is Section 42 of the Electricity Act (Chapter 13:19). This is supplemented by the Electricity Licensing Regulations, 2008 and their amendments (SI 55/2015 and SI 101/2021).

Section 42 of the Electricity Act relating to generation licensing under Section 42(1) states that a generation licence authorises the licensee to construct, own, operate and maintain a generation station for the purpose of generating and supplying electricity. This is subject to terms and conditions imposed by the Zimbabwe Energy Regulatory Authority (ZERA) and compliance with other provisions of the Electricity Act. 

Supply of Electricity according to Section 42(2) states that the holder of a generation licence may supply electricity to any transmission, distribution or supply licensee who purchases electricity for resale. With the approval of the Commission, they may also supply electricity directly to one or more consumers, again subject to ZERA’s terms and conditions.

Per Section 11 of the Licensing Regulations, any entity operating an electric generator capable of generating, distributing, or transmitting over 100kW must obtain a licence under Section 40 of the Electricity Act. Exceptions are made if the generator is solely for household or business use, in which case the owner must notify ZERA within 60 days of acquisition. ZERA will conduct an inspection and, if the generator is deemed for personal use, will issue an indefinite permit with safety and inspection conditions.
